Terms & Conditions
These Terms & Conditions form part of the Safari Agreement between Dinkwe Safaris & Taxidermy (“the outfitter”) and the client, and are binding upon signature of the Reservation Form, Indemnity Form, Booking Form, Booking Terms & Conditions and the Agreement for any additional excursions or add-ons document.
Bookings, Deposits and Rescheduling
Deposits paid to Dinkwe Safaris & Taxidermy are non-refundable and secure the booking dates and professional hunter allocation. Deposits can only be moved to an alternative hunting date once, if agreed by both parties. Rescheduling fees may apply if the client reschedules their hunt. Rescheduling is subject to availability, and any rate increases applicable to the new safari dates. If a client booked as a hunter and opts to be an observer during the hunt, the client will still be responsible for the hunter's daily rate for the entire length of the safari as it will not be changed to an observer rate.
Species-Specific Deposits & Permits for South Africa
All permit fees are non-refundable once the permit application is submitted.
- Spotted Hyena: $500 permit fee
- Buffalo: 25% payable up front of trophy fee
- Nile Crocodile: $500 permit fee and 25% deposit towards trophy fee
- Lion: $500 permit fee and 25% deposit towards trophy fee
- Primates: $25 permit fee
All animals that have “permit” indicated on the price list require a permit in advance. Permits are issued on a first come, first served basis until the annual quota is reached and are subject to approval by the relevant authority. If a client decides to no longer harvest a specific booked animal, written notice must be given at least three (3) months prior to arrival. Failing such notice, 50% of the trophy fee remains payable and is non-negotiable due to quota allocation and opportunity loss.
Hunting Quota Obtained
If a client did not hunt all the animals that form part of a show special package, the client will still be held accountable to pay for the full package. Animals exchanged within the package are not permitted, however additional animals may be added according to the price list. If a client did not take a show special package deal and hunts from the list, he will only be held accountable for the animals hunted. The initial deposit remains deductible and non-refundable.
Trophy Fees, Pricing & Recovery
Trophy fees are payable in full at the end of the hunt prior to departure from camp. Any animal shot, wounded, and lost is considered harvested and subject to the full trophy price. Should a bullet pass through, kill, wound or miss the first target and kill another animal, the hunter will be held accountable for that animal to be paid for as well. The professional hunter's decision as to whether an animal has been wounded shall be final and binding. The outfitter will make every reasonable effort to recover wounded animals, however recovery cannot be guaranteed due to terrain, wildlife movement, or safety considerations.
Gratuities & Payments
Payment of gratuities is in US Dollar cash or card. Should gratuities be added to a credit card the 3.5% card fee on the tipping amount will be added. Tips are paid to the outfitter or designated person pointed out by the outfitter at the end of the hunt and not to individual staff members. This ensures fair and equal distribution amongst all staff involved in the safari experience, even those who you don't come into contact with. All outstanding amounts, including observer fees, extra activities, special dietary charges, and trophy fees, are payable in full at the end of the hunt prior to departure.
Hunting Restrictions & Conduct
No hunting will take place if a client is under the influence of alcohol or illegal substances. The professional hunter reserves the right to determine whether a client is fit to hunt. Any use of drugs, illegal substances, or engagement in illicit activities during the safari is strictly prohibited. Should a client elect to stop the safari or be removed from hunting activities due to the above conduct, a penalty of $2,500 will apply, payable immediately, and the client may be escorted back to the airport at their own cost.
Safety, Risk & Liability
Clients acknowledge that hunting and safari activities involve inherent risks, including but not limited to dangerous wild animals, firearms, remote areas, uneven terrain, and extreme weather conditions. While Dinkwe Safaris & Taxidermy will always do its best to ensure the safety of clients, the outfitter cannot be held liable for damages, injury, loss of life, or financial loss arising from participation in safari activities, except where prohibited by law. Clients acknowledge that there are dangerous animals, reptiles, insects, and plants in the game parks and hunting farms and that participation is entirely voluntary. Clients acknowledge that handling firearms, bows, and crossbows can be dangerous and agree to exercise extreme safety at all times. Clients acknowledge that their hunt may include physically demanding activities and confirm that they are medically fit to participate. Clients agree to abide by the decision of the professional hunter to dispatch any animal that poses an immediate threat to human life or requires humane termination. The client remains liable for all associated trophy fees and costs. Any additional costs incurred in life-threatening situations or where other trophies are shot accidentally shall be for the client's account.
Tax, Export & Insurance
Clients are responsible for ensuring compliance with firearm import/export regulations and any necessary permits required by South African authorities. The outfitter strongly recommends that every client obtains trip cancellation and emergency medical insurance and is responsible for all medical expenses, evacuation, or emergency services required during the safari.
Media & Personal Information
Photos taken during the safari may be used for promotional and/or publicity purposes by Dinkwe Safaris & Taxidermy unless the client objects in writing prior to the safari. By signing the reservation form, the client consents to the processing of personal information for purposes related to the safari booking and administration.
General
These Terms & Conditions are essential for the operation of the hunting outfitter and the overall safari experience. The professional hunter's decisions regarding safety, hunting conduct, and wounded animals shall be final.
Release of Claims
The client hereby waives, releases, and discharges Dinkwe Safaris & Taxidermy, its directors, officers, professional hunters, employees, agents, and representatives from any claims, demands, actions, or causes of action arising from participation in the safari, whether arising from negligence or otherwise, to the fullest extent permitted by the laws of the Republic of South Africa. This release applies to claims for personal injury, death, property damage, financial loss, emotional distress, or any other loss or damage that may occur during or as a result of participation in the safari. This release shall be binding upon the client's estate, heirs, executors, administrators, dependents, and assigns.
Emergency Medical Treatment & Authority
In the event of injury, illness, or medical emergency, the client authorizes Dinkwe Safaris & Taxidermy and/or the professional hunter to arrange medical treatment, hospitalization, evacuation, or emergency transportation on the client's behalf where necessary. The client acknowledges that safari areas may be remote and that access to immediate medical facilities may be limited and may require air evacuation. All medical expenses incurred during the safari, including but not limited to doctor's fees, hospitalization, emergency transport, helicopter evacuation, medication, and repatriation, shall be for the sole account of the client. The outfitter shall not be held liable for decisions made in good faith during emergency situations.
Firearms & Weapon Responsibility
Clients bringing their own firearms, bows, crossbows, or other hunting equipment confirm that they are legally entitled to possess and use such equipment. The client accepts full responsibility for compliance with all applicable South African laws relating to import permits, temporary firearm licenses, ammunition limits, transport, storage, and lawful use. Dinkwe Safaris & Taxidermy shall not be liable for confiscation, delays, fines, refusal of entry, or legal consequences arising from noncompliance with firearm regulations. The client agrees to comply strictly with all safety instructions issued by the professional hunter regarding firearm handling at all times. When a client uses an outfitter's rifle that has been successfully sighted in by the professional hunter and the client confirms that it is sighted in, the rifle is considered “dead on” or properly zeroed. If the client misses or wounds an animal, the fault lies strictly with the shooter's error.
Responsibility for Damage to Property
The client shall be responsible for any damage caused, whether intentionally or negligently, to vehicles, accommodation, camp facilities, firearms, equipment, or property belonging to Dinkwe Safaris & Taxidermy or third parties. The cost of repair or replacement of damaged property shall be payable by the client prior to departure from the safari. Unsafe handling of firearms or equipment resulting in damage shall be deemed the client's responsibility.
Unforeseen Events
Dinkwe Safaris & Taxidermy shall not be held liable for delays, cancellations, interruptions, or changes to the safari caused by events beyond its reasonable control. Such events include, but are not limited to, natural disasters, extreme weather conditions, disease outbreaks, government restrictions, permit refusals, border closures, political unrest, airline disruptions, quota limitations or theft. In such circumstances, safari dates may be rescheduled subject to availability, however refunds are not automatically guaranteed.
Taxidermy, Trophy Handling, Storage & Release
Trophies shall not be released for dip, pack, taxidermy, export, or shipment until all outstanding amounts have been paid in full. The outfitter shall not be responsible for delays in export caused by shipping agents, government authorities, or customs procedures. Should completed trophies remain unpaid or uncollected due to the client's account not being paid in full, storage fees will be applied after 3 months at $100 per week.
Taxidermy fees for ordered pedestals and flat skins/back skins are due in full at the time of order. Full payment for all taxidermy work must be made once the process begins 4 months after the safari is complete. Final instructions regarding taxidermy are binding, no changes can be made to a signed-off instruction after work commences and the option to switch to a “ship and dip” service is not available once final instructions have been approved.
Payment Methods & Exchange Rate
Payments may be made in United States Dollars or South African Rand at the prevailing exchange rate on the date of settlement. Any bank charges, international transfer fees, credit card surcharges, or related transaction costs shall be for the client's account. Interest may be charged on outstanding amounts not settled prior to departure.
Right of Refusal
Dinkwe Safaris & Taxidermy reserves the right to refuse participation in hunting activities where, in the opinion of the professional hunter, the client's conduct, physical condition, or safety awareness poses a risk to themselves or others. Such refusal shall not entitle the client to a refund of deposits or daily rates.
Entire Agreement & Severability
These Terms & Conditions, together with the Booking Terms & Conditions, Reservation Form, Booking Form and Indemnity Form constitute the entire agreement between the parties. No amendment or variation shall be binding unless reduced to writing and signed by both parties. Should any provision of these Terms & Conditions be found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
